| Since many people are exposed to harsh licenses with threatening terms, and a high conflict factor, it is often assumed that disputes lead quickly to litigation. However, many disputes can be resolved through a fair hearing of the perspectives and an informative, impartial observation of the issue, framed against an experienced industry view. The Technology Transfer Seminar given by the Licensing Executive Society identifies eight forms of Alternative Dispute Resolution (ADR), and several of them do not involve any courtrooms or judges, and a couple do not even require attorneys. In these less contentious forms of dispute resolution, information surrounding the conflict and about best practices and other practical resolutions can be the most important tool. DTI can participate in several roles, providing information, analysis and guidance to the parties who want to resolve conflicts and get back to work. |
